False Green Advertising

          The firm has also been active in the area of “false green advertising” or “greenwashing.”  For example, in 2003, the firm prosecuted a class action against several major retail grocery chains alleging false advertising regarding the claimed pesticide residue content of fresh produce.  The case settled with the retailers agreeing to change the challenged advertising to make it accurate and not misleading.

          In another case, the firm prosecuted an action against several pesticide application companies regarding advertising claims that their application of pesticides is “safe.”  The case settled with the companies agreeing to stop making this advertising claim.
